"Win a $1000 Shopping Spree" Official Rules
ELIGIBILITY: Win a $1,000 Shopping Spree is open to all legal residents of the United States of America who are 18 years or older as of the date of entry. The contest is subject to all federal, state and local laws and is void where prohibited or restricted by law. No purchase is necessary to compete in this Contest. A purchase will not increase chances of winning. Employees of PLTNM Creative Media and the Sponsors, and their respective parent companies, divisions, affiliates and subsidiaries, and their immediate family members (spouse, parent, children and siblings, and their respective spouses) regardless or where they live and household members (whether related or not) are ineligible to participate. ENTRY PERIOD: The Contest begins November 20th, 2008 and ends March 30, 2009. All entries must be received online by March 25, 2009 by midnight. Potential winners will be notified on or around April 2, 2009. SPONSOR: The Contest is sponsored by PLTNM CREATIVE LLC AGREEMENT TO OFFICIAL RULES: By signing up for the Contest, the entrant fully and unconditionally accepts these Official Rules and the decisions of PLTNM CREATIVE MEDIA, which are final and binding. Winning is contingent upon fulfilling all requirements set forth herein. HOW TO ENTER: Submit your information via the PLTNMCARD.com website or by sending a 4 x 6 postcard with your name, address, phone and email to PLTNM CREATIVE MEIA box 8040, Red Bank, NJ 07701. PRIZES: Grand Prize (1) (Retail Value $1000) will be given in the form of a gift card from a selection of participating PLTNM retailers or restaurants. No cash equivalents, substitutions or transfer of prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize is unavailable. The Prize must be accepted as awarded without substitution and cannot be transferred. All taxes, fees and any incidentals and other expenses not specified herein, including without limitation, income taxes, associated with the prize(s) and receipt thereof are the sole responsibility of the prize winner(s). Limit of one prize per person, family or household. CONDITIONS: By entering the Contest, potential winners agree that PLTNM CREATIVE MEDIA LLC, its Sponsors, jand each of their directors, officers, employees, agents, representatives, successors, assigns and all others associated with the development and execution of this Contests shall not be held liable for any injuries, losses or damages, including death, resulting from participation in this Contest or prize acceptance. All contestants, as a condition of entry into the Contest, agree to release PLTNM and its Sponsors from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages and/or losses of any kind arising directly or indirectly from participation in this Contest or with the receipt, ownership, use or misuse of any prize awarded or for any typographical, technical, printing or any other error in these Official Rules or with the announcement of or offering of any prize. The winner shall bear all risk of loss or damage to their prize after it has been delivered. INTERNET: By participating, entrants agree to comply with these Official Rules including all eligibility requirements. Entries not complying with these rules are subject to disqualification. If for any reason this Contest is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsors reserve the right at their sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest in whole or in part, at any time, without notice and award the prizes using all non- suspect eligible entries received as of this termination date. Sponsors assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The Sponsors are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. WAIVER: By entering this Contest, participant waives all rights to claim punitive, incidental, direct, indirect and/or consequential damages, attorneys’ fees or any damage other than actual out-of-pocket costs that may arise in connection with participation in the Sweepstakes or acceptance, possession and use of any prize. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims, causes of action arising out of or connected with the Contest or any prize awarded shall be resolved individually, without resort to any form of class action and exclusively by the courts of the State of New Jersey.
